"Given that ‘evidence relating to gang involvement will almost always be prejudicial,’" the Court held, "the minimal probative value of testimony is easily outweighed by the tremendous risk of unfair prejudice . . . and so it should be excluded if the case is retried." Id. (citing Kennedy v. Lockyer, 379 F.3d 1041, 1055 (9th Cir. 2004)) (emphasis provided). While this authority won’t help us in those RICO / VICAR / gang-enhancement cases where gang ties are basically an element of the offense, this case law is pretty strong medicine for those cases where gang membership is a more tangential issue. Fed. R. Evid. 403 still seems to have teeth when it comes to gang evidence, in both civil and criminal cases.

- [San Diego and the First Amendment: Who decides what is art?](https://mckenziescott.com/featured-cases/san-diego-and-the-first-amendment/): San Diego native and local artist Sara Duvall has been making and sharing her art for years.  She was trained locally (and internationally) and now gives back to the community by teaching as well.  Sara has shown her work in galleries, received awards for her art, and—most recently—been fined repeatedly by the City of San Diego for sharing her art with the public in Balboa Park.  Why? Because after the City of San Diego passed its Sidewalk Vending Ordinance in early 2024, it decided that Sara is no longer an artist but instead a “vendor” not worthy of First Amendment protections.

- [Timothy A. Scott](https://mckenziescott.com/team/timothy-scott/): Tim Scott graduated from Stanford Law School in 2000, and received his undergraduate degree from Whitworth College in 1997 summa cum laude. He began his career as a trial attorney with Federal Defenders of San Diego, Inc. before starting what became McKenzie & Scott in 2021. Consistently ranked by peers as a “San Diego Super Lawyer,” and “Southern California Super Lawyer” for both trial-court and appellate categories, Tim is the rare advocate who combines the skills of an accomplished trial lawyer, appellate attorney, and legal scholar.
- [Michele Akemi McKenzie](https://mckenziescott.com/team/michele-akemi-mckenzie/): Michele McKenzie is one of the founding partners of McKenzie Scott PC. Before entering private practice in 2019, Ms. McKenzie worked for almost two decades at the community defender organization for the Southern District of California, Federal Defenders of San Diego, Inc. While at Federal Defenders of San Diego, Inc., Ms. McKenzie served as a Trial Attorney, Trial Team Leader, Supervisory Attorney, and First Assistant arguing cases in U.S. District Court and before the U.S. Court of Appeals for the Ninth Circuit.
- [Marcus S. Bourassa](https://mckenziescott.com/team/marcus-bourassa/): Marcus Bourassa received undergraduate and graduate degrees from Stanford University before earning a juris doctor from Stanford Law School. Between stints at Stanford, Marcus served as an intelligence officer in the United States Marine Corps, where he deployed to Afghanistan and managed a team of professional interrogators and confidential sources. At Stanford Law School, Marcus became a regional mock trial champion, was elected student-president, and received the Dean’s Award for Excellence in Service as well as top honors in criminal law, administrative law, and contract law.
- [Nicolas O. Jimenez](https://mckenziescott.com/team/nicolas-jimenez/): Following law school, Mr. Jimenez clerked for the Hon. Jose Alberto Morales, Appellate Judge, Court of Appeals of Puerto Rico. He began working with Tim Scott in 2013, and since then has focused his efforts on defending federal criminal cases, prosecuting appeals to the Ninth Circuit, and litigating federal civil rights cases and personal injury actions before California courts. Mr. Jimenez is also an adjunct professor at California Western School of Law, teaching courses on the Federal Rules of Evidence, Federal Civil Procedure, and Federal Civil Motions Practice, within the law school’s LL.M. program for Latin American attorneys and judges.
- [Lauren Mellano](https://mckenziescott.com/team/lauren-williams/): After graduating magna cum laude, Lauren began her legal career with a two-year federal judicial clerkship for a district judge in the Southern District of California. She then went on to work as a federal public defender at the Federal Defenders of San Diego, Inc. for close to five years. As a public defender, Lauren defended indigent clients charged with various federal felonies such as illegal reentry, smuggling undocumented people, drug importation, gun charges, child pornography, and RICO charges. She obtained several dismissals by the government in trial-bound cases and negotiated misdemeanors for clients charged with felony assault and illegal entry. She has briefed appeals and argued before the Ninth Circuit. She was successful in securing the government’s concession in one appeal as well as securing a partial reversal in another.
- [Michelle Angeles](https://mckenziescott.com/team/michelle-angeles/): Before becoming a public defender, Ms. Angeles spent years on the front lines of social justice campaigns. During college, she interned for the United Nations Population Fund, Division of Arab States, Eastern Europe, and Central Asia focusing on issues related to gender, culture, and human rights. Between college and law school, Ms. Angeles worked for Proyecto Pastoral, a social justice, community-building nonprofit in Boyle Heights, Los Angeles. Their mission is to empower the community of Boyle Heights through grassroots projects in education, leadership, and service. They provide support to children and families through early childhood education centers, youth development programming, homeless shelters, community organizing efforts and collective impact work. Through a blend of community services and organizing, Proyecto seeks to build community power so that community residents - those most impacted by these systemic inequities - create transformational change rooted in values of justice, opportunity, and self-determination. Passionate about Proyecto’s mission and commitment to the community - Ms. Angeles served as the Development Associate and Operations Manager for three years. She continues to be passionate about advancing the rights and protecting the interests of immigrant and indigent communities and has dedicated her time, efforts, and career to advancing the ideal of equal justice for all.

Her experience in education and the legal field helps her communicate with clients with compassion and efficiency. Ms. Calderon was born and raised in Southern California. In her spare time, she enjoys, painting, being outdoors, and spending time with her family and friends.
- [Gabriela Gonzalez](https://mckenziescott.com/team/gabriela-gonzalez/): Growing up in Los Angeles, as a Mexican-American child, Gaby learned at an early age that her community was too often disadvantaged in systemic and unfair ways and decided that she wanted a career where she could work to uplift her community. Gaby is proud to dedicate her time and efforts to taking care of clients, working for justice, and making sure that everyone—regardless of means—is treated fairly and with dignity.

- [Bianca Perez](https://mckenziescott.com/team/bianca-perez/): Bianca is McKenzie Scott’s lead criminal defense paralegal. She is skilled in prepping cases for trial and supporting attorneys during trial with electronic discovery management tools and trial presentation software. Bianca has assisted in preparing civil and criminal cases for trial at both the state and federal levels. She has been the lead trial paralegal in federal court in civil and criminal cases.
